Welcome to Mend. These Terms of Service ("Terms") govern your use of the Mend mobile application (the "App"), including all related services provided by Mend ("we," "us," or "our"). By downloading, installing, or otherwise using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use or access the App.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. By using the App, you represent and warrant that you satisfy this requirement.
Mend is intended for use by consenting adults. You and your partner should both agree to participate in any exercises or voice-based sessions.
Always exercise caution. The App is not a substitute for professional counseling, therapy, or medical treatment. If you or your partner are in crisis, experiencing severe mental health issues, or have suicidal thoughts, seek immediate professional help. Mend provides conversational guidance only; it does not diagnose, treat, or cure any health condition.
The App facilitates voice-based, AI-moderated conversations between you and your partner to help improve communication, resolve conflicts, and foster emotional intimacy.
Features include real-time speech transcription (on-device), AI-generated conversation prompts, post-session reflection exercises, and an insights dashboard.
All AI processing (speech-to-text and conversation guidance) is performed locally on your device; no audio or transcript data is sent to third-party servers, except as explicitly stated in our Privacy Policy.
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, for any reason, without prior notice.
You are responsible for maintaining the confidentiality of your account credentials (if applicable).
You must provide accurate and complete information during onboarding (e.g., birth date, relationship status).
Use the App only as intended. Do not attempt to reverse-engineer, decompile, or otherwise tamper with the App's code or functionality.
You must comply with all applicable laws and regulations when using the App, including but not limited to intellectual property, privacy, and data protection laws in your jurisdiction.
Any content you share with your partner (voice, text) must not violate third-party rights (e.g., copyrighted material, defamation, hate speech).
Please review our Privacy Policy (available at www.mendexperience.com/privacy) to understand how we collect, use, and store your personal information.
All transcription and AI inference occur locally on your device. We do not store or transmit audio recordings or text transcripts to our servers, except in anonymized or aggregated form strictly for analytics purposes (with your explicit consent).
You may be required to sign in or link with a third-party account (e.g., Google, Apple) to access certain features. Any permissions (microphone, storage) are requested at runtime and only used for core App functionality.
By using the App, you consent to our collection and usage practices as described in the Privacy Policy.
The App and all associated content, including but not limited to trademarks, logos, graphics, text, audio prompts, and AI models, are owned or licensed by Mend and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on any part of the App, except as expressly permitted in writing by Mend.
Any feedback, suggestions, or improvements you provide are non-confidential and become the exclusive property of Mend without any compensation to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
MEND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE APP MAY CONTAIN BUGS, ERRORS, OR INCONSISTENCIES. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, NOR DO WE GUARANTEE SPECIFIC RESULTS FROM USING THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEND, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE APP.
OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR USING THE APP IN THE LAST TWELVE (12) MONTHS PRIOR TO THE CLAIM.
Some features of the App may be offered on a subscription or paid basis. Any in-app purchases must be processed through Google Play's or Apple's billing system, per their respective policies.
All subscription fees (if applicable) are billed in advance and are non-refundable except as required by applicable law.
You are responsible for reviewing the app store's subscription terms, including auto-renewal, cancellation, and refund policies.
Mend does not directly charge your credit card or collect payment outside of the app stores. Any payment disputes must follow the respective app store's dispute resolution process.
This App is distributed via Google Play Store and Apple App Store and must comply with all respective Developer Program Policies (including but not limited to content, privacy, and security requirements).
The App does not request any permissions other than those necessary for core functionality (e.g., microphone access for voice calls, storage access for caching transcripts).
We do not collect or share personally identifiable information (PII) without user consent.
For age-restricted or sensitive content, users are required to be 18+ and agree to these Terms prior to using the App.
If you find content in the App that violates app store policies, please report it immediately at vnayan@persistventures.com.
We may suspend or terminate your access to the App, in whole or in part, at any time and for any reason, including if you breach these Terms or violate any applicable laws.
Upon termination, your right to use the App will immediately cease. All sections of these Terms that by their nature should survive termination shall survive, including disclaimers, limitation of liability, and intellectual property provisions.
We reserve the right to modify these Terms at any time. When we do, we will post the revised Terms within the App and update the "Last Updated" date at the top.
Continued use of the App after such changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App and uninstall it.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the App shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
